Product Contact Point for Construction

The basic provisions governing the matters concerning functioning of Product Contact Point for Construction in Poland include:

  • provisions of Article 10 of Regulation (EU) No 305/2011(1)
  • Article 14(1) point 7 of Act on construction products(2)

According to Regulation (EU) No 305/2011(1), in order to facilitate the free movement of goods, Product Contact Points for Construction primarily provide information free of charge, on the provisions aimed at fulfilling basic requirements for construction works applicable for the intended use of each construction product, in the territory of each Member State.

The duties of Product Contact Point for Construction in Poland include:

  • provision of information, using transparent and easily understandable terms, on the provisions, in force within the territory of Poland, aimed at fulfilling basic requirements for construction works applicable for the intended use of each construction product, as provided for in Article 6(3)(e) of Regulation (EU) No 305/2011 (pursuant to Article 10(3) of the above-mentioned Regulation).

In addition, the Contact Point provides on-line the information referred to in Article 9(2) of Regulation (EU) 2019/515(2):

a)     information on the principle of mutual recognition and the application of Regulation (EU) 2019/515 in the territory of Poland, including information on the procedure set out in Article 5 of the above-mentioned Regulation,

b)     the contact details, by means of which the competent authorities in Poland may be contacted directly, including the particulars of the authorities responsible for supervising the implementation of the national technical rules applicable in the territory of their Member State,

c)      information concerning the remedies and procedures available in the territory of Poland in the event of a dispute between the competent authority and an economic operator, including the procedure set out in Article 8.

  • Where necessary to complement the above-mentioned information provided online, it shall provide, at the request of an economic operator or a competent authority of another Member State, information, such as electronic copies of, or online access to, the national technical rules and national administrative procedures applicable to specific construction products or construction products of a specific type on the territory of Poland or information, on whether those products are subject to prior authorisation in accordance with national law.

However, the tasks of Product Contact Point for Construction in Poland do not include in particular:

  • interpretation of the provisions of Regulation (EU) No 305/2011, Act on construction products(3) and other provisions concerning construction products (general explanations concerning the application of above-mentioned regulations are provided in Polish by the Construction Products Department of GOBC),
  • interpretation of the provisions of Act – the Buildig Law(4) (general explanations concerning the application of regulations in this respect are provided by the Legal Department of GOBC),
  • providing press information (the Spokesperson of the GIBC provides information in this regard),
  • providing administrative and legal advice (e.g. assessment of the manufacturer’s documents or the performance of a specific product, because it is the manufacturer, importer or seller who must decide and assess whether the product placed or made available on the market meets certain requirements).

Responses shall be given 15 working days of receipt of the request.

Product Contact Point for Construction does not charge any fees for providing information.

On the GOBC websites there is a list of regulations in force in Poland on technical requirements, which contain technical provisions.

The European Commission publishes on its websites information on regulations concerning CE marked construction products. On these websites there are among others EC answers to frequently asked questions on the application of Regulation (EU) No 305/2011. The information is in English.
The brochure "CE marking of construction products step by step" is also available on the Commission's websites in all languages of the EU Member States. It is designed for economic operators who place CE-marked construction products on the EU internal market.

There is a Product Contact Point in the Ministry of Development, which makes available or provides information within the scope of Article 9(2 and 3) of Regulation (EU) 2019/515, that is, inter alia, information concerning the principle of mutual recognition and the national technical rules and national administrative procedures applicable to specific goods or goods of a specific type in the territory of the Republic of Poland, as well as information on whether the goods or goods of a particular type are subject to prior authorisation under Polish law.
